			<content:encoded><![CDATA[<p>In May 2009, the President signed the <a href="http://www.whistleblowerfirm.com/wp-content/uploads/2009/06/FCA-Amendments-FERA.pdf" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/wp-content/uploads/2009/06/FCA-Amendments-FERA.pdf?referer=');">Fraud Enforcement Recovery Act</a>, sponsored by Senator Chuck Grassley and Senators Patrick Leahy and Ted Kaufman, made major changes to strengthen the federal False Claims Act by removing liability loopholes and addressing statutory confusion. Additional related, though less extensive changes, were made as part of the Patient Protection and Affordable Care Act enacted in March 2010, Grassley is now working to make sure that the recent changes made to the federal <a href="http://www.whistleblowerfirm.com/about-the-law/false-claims-act-text/" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/about-the-law/false-claims-act-text/?referer=');">False Claims Act</a> are recognized and incorporated by the 14 states that already have OIG-approved state False Claims Acts.</p>
<p>Consistency by a state with the Federal False Claims Act, is a requirement for a large federal incentive afforded to the state, when Medicaid dollars are successfully recovered in a Federal False Claims Act lawsuit. The federal incentive allows states to receive an additional 10% of the Medicaid recoveries if they allow whistleblower/qui tam lawsuits in their state False Claims Acts, as long as the state False Claims Acts afford the same rights to whistleblowers as the federal False Claims Act does.</p>
<p>In an April 28, 2010 press release , Grassley asked the Inspector General for the Department of Health and Human Services and the Attorney General to review existing state False Claims Acts, to make sure they are in compliance with recent changes to the federal False Claims Act; and to issue appropriate guidance for any state interested in the federal incentive.. In addition to the 14 states which have already qualified for this incentive (and are now subject to this review), six states applied for it but did not meet the requirements.</p>

			<content:encoded><![CDATA[<p>Sixty-four percent of business professionals polled during a recent Deloitte webcast think the Fraud Enforcement and Recovery Act will be effective in increasing the total dollar amount the government will recover under the <a href="http://www.whistleblowerfirm.com/about-the-law/false-claims-act-history/" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/about-the-law/false-claims-act-history/?referer=');">False Claims Act</a>, according to a Jan. 27 Deloitte press release.</p>
<p>Respondents indicated their greatest concerns under the Fraud Enforcement and Recovery Act&#8217;s enforcement changes are: an expanded universe of companies potentially liable for FCA violations (24 percent); increased consequences of failing to return overpayments to the government (13 percent); extended whistleblower protections to non-employees (12 percent); and revived government ability to use Civil Investigative Demands (11 percent).</p>
<p>Approximately two-thirds (66 percent) of respondents were unaware that private <a href="http://www.whistleblowerfirm.com/about-the-law/qui-tam/" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/about-the-law/qui-tam/?referer=');">qui tam</a> plaintiffs &#8212; or whistleblowers &#8212; can bring suits under the FCA on behalf of the U.S. government against companies misusing government funds and keep a share of recovered funds.</p>
<p>Respondents expect that the financial services (44 percent) and health care and life sciences (23 percent) industries will see the highest increase in litigation resulting from increased Fraud Enforcement and Recovery Act, as well as FCA enforcement activity.</p>
<p>More than 800 business professionals from the banking and securities, consumer and industrial products, energy, resources and power, financial services, health care and life sciences, public sector technology, media and telecommunications and manufacturing industries responded to the online polling questions during an October 2009 Deloitte webcast.</p>

			<content:encoded><![CDATA[<p>The United States Department of Justice announced December 17, 2009 that the U.S. and state of New York have entered into settlement agreements with three home health agencies to resolve allegations that they submitted false claims to the New York Medicaid and Medicare programs.</p>
<p>The U.S. contends that Nursing Personnel Home Care knowingly supplied aides with phony training certificates to Extended Home Care and Excellent Home Care, which then billed New York Medicaid for the aides&#8217; services. Allegedly, Extended Home Care and Excellent Home Care knowingly billed for aides with phony certificates who were untrained, and Extended Home Care and Excellent Home Care knowingly submitted claims to the Medicare program for home health aide services purportedly rendered by aides supplied by Nursing Personnel Home Care that were not actually provided.</p>
<p>The U.S. is receiving about $9.7 million as a result of the settlement with these three companies, and the state of New York is receiving about $14.3 million, for a total recovery of $24 million.</p>
<p>The allegations resolved by these settlements were initiated by two lawsuits filed under the whistleblower provisions of the <a href="http://www.whistleblowerfirm.com/about-the-law/what-is-a-false-claim/" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/about-the-law/what-is-a-false-claim/?referer=');">False Claims Act</a>.</p>

<p>The United States secured $2.4 billion in settlements and judgments in cases involving fraud against the government in the fiscal year ending Sept. 30, 2009, the Justice Department announced November 19, 2009. 			<content:encoded><![CDATA[<p>Covenant Medical Center in Waterloo, Iowa has agreed to pay the United   States $4.5 million to resolve allegations that it violated the <a href="http://www.whistleblowerfirm.com/about-the-law/false-claims-act-history/" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/about-the-law/false-claims-act-history/?referer=');">False Claims Act</a>, the Department of Justice announced today.</p>
<p>This settlement resolves allegations that Covenant submitted false claims to Medicare by having financial relationships with five physicians that violated the Stark Law. The United   States alleged that Covenant violated the Stark Law by paying commercially unreasonable compensation, far above fair market value, to five employed physicians who referred their patients to Covenant for treatment. These physicians were among the highest paid hospital-employed physicians not just in Iowa, but in the entire United   States, according to the DOJ.</p>

			<content:encoded><![CDATA[<p>The State of California has joined a <a href="http://www.whistleblowerfirm.com/qui-tam/" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/qui-tam/?referer=');">qui tam</a> action against seven private laboratories to recover hundreds of millions of dollars in <a href="http://www.whistleblowerfirm.com/federalfalseclaimsact.html" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/federalfalseclaimsact.html?referer=');">false claims </a>submitted to the state&#8217;s Medi-Cal program for the poor, according to a March 20 press release by the California Office of Attorney General.</p>
<p>The lawsuit contends that the medical labs systematically overcharged the Medi-Cal program during the past 15 years. The defendants, including Quest Diagnostics and Laboratory Corporation of America, allegedly engaged in illegal kickbacks and overcharging the state by up to 400% for blood, urine and other lab tests. It is estimated that damages could amount to hundreds of millions of dollars.</p>
<p>Filed under California&#8217;s <a href="http://www.whistleblowerfirm.com/federalfalseclaimsact.html" onclick="pageTracker._trackPageview('/outgoing/www.whistleblowerfirm.com/federalfalseclaimsact.html?referer=');">False Claims Act</a>, the qui tam lawsuit asks for relief in the amount of triple the amount of California&#8217;s damages, civil penalties of $10,000 for each false claim; and recovery of costs, attorneys&#8217; fees and expenses.</p>
<p>This is one of the largest, if not the largest, single state qui tam intervention against multiple laboratories, in history.</p>

Schapiro announced that the SEC is considering offering cash rewards to whistleblowers who expose financial wrongdoing, according to a March 12, 2009 Washington Times article. The practice of offering cash bounties to securities fraud whistleblowers would be similar to financial rewards given to people who help to expose insider-trading. Having this power, Schapiro said in the article, would enable the SEC to pursue cases more aggressively.</p>

			<content:encoded><![CDATA[<p>The United States is intervening in a whistleblower suit that alleges that Community Health Systems Inc. (CHS) and three of its hospitals in New Mexico violated the False Claims Act (FCA) by presenting the government with false claims for federal matching Medicaid funds.</p>
<p>According to the U.S. Department of Justice, which made this announcement March 6, 2009, the suit was filed under the qui tam or whistleblower provisions of the FCA by Robert Baker, a former revenue manager in CHS’s corporate office.</p>
<p>The relator’s complaint alleges that, beginning in 2000, CHS and its hospitals improperly obtained federal funds through the New Mexico Sole Community Provider Fund (SCPF) and Sole Community Hospital Supplemental Payments (SCHSP) Medicaid programs.</p>

Chuck Grassley (R-Iowa) (S. 458), could fuel government’s ability to recover taxpayers’ dollars lost to fraud and abuse by increasing government accountability and extending whistleblower protection. Under the new legislation, the attorney general would be required to submit an annual report to Congress about settlements made under the FCA. This would help determine if the Department of Justice is using the act as it is intended and ensure that qui tam relators are protected from the court’s potential abuse of provisions to seal a case.</p>

			<content:encoded><![CDATA[<p>On April 20, 2007, the Loma Linda Behavioral Medicine Center paid the United States government in excess of $2 million to settle allegations of overbilling from 1992-1996.  The settlementis the result of a lawsuit filed by a whistleblower under the False Claims Act.  The lawsuit was originally filed in 1998 by a former employee of Healthcare Financial Advisors (HFA), a consulting firm that assists hospitals in preparing cost reports that are submitted to insurers.  The lawsuit alleged that Healthcare Financial Advisors prepared for clients two costs reports; one which was inflated and sent to Medicare and another one designed for internal use only, that accurately reflected the amount of reimbursement the hospital should have received from Medicare.  It should be noted that seven defendants thus far have settled the HFA whistleblower lawsuit, paying approximately $55 million to the government. (Jackson Memorial Hospital in Miami, Florida more than $14 million; St. Elizabeth Regional Medical Center in Lincoln, Nebraska more than $4 million, Lovelace Health System, a wholly owned subsidiary of Cigna Corp. based in Albuquerque, New Mexico, paid $24.5 million in 2002; St. Joseph’s Hospital in Houston, Texas, paid the government $1.5 million in 2002; Eisenhower Medical Center, located in Rancho Mirage, Calif., paid $8 million in 2005 and HealthSouth Bakersfield Rehabilitation Hospital in Bakersfield, Calif., paid $740,000 in 2005).</p>

			<content:encoded><![CDATA[<p>Harris County, a part of the Houston, Texas healthcare system for the needy became the system for the greedy when it overcharged the federal government by district employees who”were asleep at the switch,”according to Commissioner Steve Radack. During 200-2005 federal programs were billed for treating hosptialized county jail inmates when in fact the Sheriff’s Office, which runs the jail should have been billed.  Medicare and Medicaid were also billed for people injured in car accidents when it should have billed their auto insurers. A district employee blew the whistle on the improper billing and therefore, under federal law will qualify for a percentage of the $15 million paid to the federal government.</p>

			<content:encoded><![CDATA[<p>A former contractor of Integris blew the whistle on Integris Health, Inc., alleging that it was submitting inflated claims to Medicare. The complaint stated that Integris sought payment from Medicare for post and non-transplant related costs that Integris knew were not reimbursable under the Medicare program. In addition,the Complaint alleged that Integris claimed Medicare reimbursement for liver and heart organ acquisition costs related to transplant patients who were not Medicare beneficiaries. The whistleblower will receive $2.3 million as a share of the recovery under the False Claims Act. Integris Baptist Medical Center, a not-for-profit health organization, is located in Oklahoma City, Oklahoma and operates the largest Medicare certified Heart, Liver and Kidney transplant program in the state of Texas. Integris Health, Inc. is the parent corporation for Integris Baptist Medical Center.</p>

			<content:encoded><![CDATA[<p>The Ninth Circuit Court of Appeals in San Francisco, California reinstated a federal qui tam case filed by two former employees of the University of Phoenix alleging that the school enrolled unqualified students to get federal funding. Recruiters were rewarded based on the number of students they enrolled.  The lower court had previously dismissed the suit stating that the False Claims Act did not cover such conduct. Of note was the fact that the United States Department of Justice filed an amicus brief stating that the ruling by the district court “could impair enforcement of the False Claims Act ”.  While a federal appeals court in New Orleans had previously dismissed three cases that were similar to the University of Phoenix case, a Chicago federal court of appeals ruled consistently with the Ninth Circuit.</p>

			<content:encoded><![CDATA[<p>A May 9, 2006, Los Angeles Times article (Lisa Girion, U.S. Programs May Exclude Tenet Hospital, The Los Angeles Times, May 9, 2006 at C9), it was reported that, “… the Department of Health and Human Services’ Office of Inspector General notified Dallas-based Tenet that it intended to exclude Alvarado Hospital Medical Center in San Diego from the Medicare program, the Medicaid plan for the poor and all other federal health programs. The decision is based on allegations that Alvarado paid kickbacks over 10 years in order to induce doctors to refer patients for services and items paid for by the federal programs. ” This action follows two mistrials in which jurors were unable to agree as to whether Tenet, Alvarado Hospital Medical Center and a former employee were guilty of related criminal charges.
